What Personal Information does Positive Fusion collect?
In the course of serving its clients, Positive Fusion acquires, stores and transmits client communications and information that clients may regard as private or sensitive. Some of this information - such as the client's name, address, telephone number, and credit card data - is provided to Positive Fusion by its clients in order to establish service. Other information - such as the client's account status, choice of services, and client logs - is created and maintained by Positive Fusion in the normal course of providing service. Positive Fusion may also use cookies, which are small pieces of information that a web site can store in a designated file on a user's computer for various reasons. In addition, Positive Fusion may store clients' electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.
Data Security
Positive Fusion will protect the confidentiality of its clients' information, account information and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of Positive Fusion, its partners, its employees and other clients of Positive Fusion’s services. To protect the loss, misuse, and alteration of information that is collected from clients, Positive Fusion has appropriate physical, electronic, and managerial procedures in place.
How is client information used?
Positive Fusion will only use client information to provide its clients with system information or information about new or upgraded products and in order to provide requested services.
Modification of client information
Clients may modify their personal information by logging a support request or by using our client center.
Domain name clients, who have registered a domain name through Positive Fusion: Positive Fusion provides all clients with full access to their domain account by sending them their own username and password. It is important to note that client domain name registration information is made publicly available in the registry of domain names. In the event you lose your domain registration password, please request the password via domain registration support.
What about privacy on sites that Positive Fusion links to?
Positive Fusion may provide links to its partners and other Internet sites. These sites have separate data and privacy practices independent of Positive Fusion, and Positive Fusion disclaims any responsibility or liability for their policies or actions.
Disclosure of client information and communications
Positive Fusion will not otherwise disclose its clients' personal and account information unless Positive Fusion has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of Positive Fusion, Positive Fusion’s clients, or others, or where Positive Fusion has a good faith belief that the law requires such disclosure.
Positive Fusion also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that Positive Fusion stores or transmits for its clients. The circumstances under which Positive Fusion will disclose such electronic client communications are when:
- it is necessary in order to provide service to the client;
- it is necessary to protect the legitimate interests of Positive Fusion and its clients;
- it is required to cooperate with interception orders, warrants, or other legal process that Positive Fusion determines in its sole discretion to be valid and enforceable; and
- it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by Positive Fusion and appear to pertain to the commission of a crime.
Positive Fusion disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by clients or others. Positive Fusion will, however, review, delete or block access to communications that may harm Positive Fusion, its clients or third parties. The grounds on which Positive Fusion may take such action include, but are not limited to, actual or potential violations of Positive Fusion’s Acceptable Use Policy.
